      "[FullRow]Condition": "This permit is issued to resolve violation #20230410137 for clearing wetland buffer in violation of the County Wetland Ordinance.  This clearing activity resulted in a total of 35,283 square feet of wetland buffer impact. \n\nAn inspection revealed that clearing has occurred within the wetlands and/or buffer in violation of the County Wetland Ordinance.  To resolve this violation, planting will be required within the altered area.  Planting must be done in accordance with the Volusia County Habitat Planting Guidelines placed with the permit package.  Please refer to the approved restoration plan attached to and made a part of this permit. Any changes to the approved plan must be approved by Environmental Management prior to implementation. Planting must be completed prior to the final wetland inspection for this permit.\n\nPlanted materials must be monitored and replaced as necessary to assure a survival rate of eighty (80) percent for a minimum of three (3) years.  All exotic and nuisance plants should be removed periodically to achieve 100% native recruitment or contain no more than 10% exotic/nuisance species throughout the three-year monitoring period. \n\nA late fee has been assessed for work begun prior to issuance of this wetland alteration permit.\n\nThere must be no erosion into the portions of the wetlands and/or buffers which have not been permitted to be altered.  A turbidity barrier is required to be placed around the permitted area in such a way as to prevent erosion into the unpermitted portions of the wetlands and/or buffers.  The barrier is to be installed prior to the start of project and is to be maintained daily.  The barrier must be left in place until the final wetland inspection has been completed.\n\nIssuance of a Volusia County permit does not relieve you from the responsibility to obtain and abide by any other permits that may be required by other agencies (which include, but are not limited to, the Florida Department of Environmental Protection, St. Johns River Water Management District, and U.S. Army Corps of Engineers).  Any environmental easement must be protected and not disturbed.\n\nThis property has been identified as containing suitable habitat for the gopher tortoise (GT), a state threatened species. Pursuant to Section 72-1140 of the Land Development Code, a 100% GT burrow survey is required to be conducted by an Authorized Agent to determine if GT burrows or their 25-foot buffers are located on the property.  A survey was conducted at the initial inspection and no GT burrows were located at the time of the site inspection. This survey expires 90 days after the initial inspection.  It is the responsibility of the owner and/or contractor to locate additional burrows or burrows that are established after our inspection.  All precautions are to be taken to protect the burrows during and following the construction activity. The Florida Fish and Wildlife Conservation Commission must permit the relocation of gopher tortoise(s) and a copy of the permit must be submitted to the Volusia County Environmental Management Division prior to clearing.
