| message | The NetDocuments Compliance Department has recently received several formal letters from customers in the financial services industry regarding our obligation to comply with the 72-hour incident notification requirement under recently amended SEC Regulation S-P. The standard NetDocuments Master Services Agreement and our own policies provide for notification to affected customers within 24 hours of confirmation of a security incident involving unauthorized access to customer repository data, and notice to all customers within 48 hours if the incident involves more than 25 customers. (Please refer to the services agreement, Exhibit B, paragraph 13.) We believe our more stringent policy satisfies and exceeds the requirements of the amended rule and no modification of our obligations to our customers to comply with the amended rule are required.
