Description

I. JOB SUMMARY Performs advanced managerial legal work. Work involves directing and planning the agency’s legal activities; interpreting laws, rules, and regulations; preparing legal documents; rendering legal advice and counsel; consulting with attorneys; preparing cases for hearings and trials; coordinating the drafting and negotiation of contracts; drafting bills for legislative consideration; and supervising the work of others. Works under limited supervision and considerable latitude for the use of initiative and independent judgment. II. ESSENTIAL FUNCTIONS A. Directs the activities of staff within the Office of the General Counsel; directs and plans the agency's legal activities; participates in the strategic planning process; provides legal expertise and services in agency litigation; and coordinates efforts in pursuit of agency goals, objectives, and mission. B. Formulates, coordinates, and establishes agency policies and procedures; provides legislative consultation, guidance, and analyses; provides legal advice and opinions on policy decision making; advises on the interpretation, application, and enforcement of agency laws and regulations; and ensures compliance with laws pertaining to the program areas. C. Prepares legal opinions, briefs, and other legal documents; assists in the preparation, development, and review of legislation; coordinates the drafting and review of legal documents, bills, administrative rules, and amendments for legislative consideration; and reviews and monitors program budget requests. D. Interacts with attorneys from the Office of the Attorney General on agency litigation issues; monitors litigation actions; and provides updates to agency administrators on litigation progress, judgments, and settlement activities. E. Provides liaison with agency staff and administrators, other local, state, and federal agencies and organizations, legislative staff, and the public; represents the agency at business meetings, hearings, trials, legislative sessions, conferences and seminars, and on boards, panels, and committees; and testifies at hearings, trials, and legislative meetings. F. Supervises the work of others; and identifies staff development and training requirements. * Performs a variety of marginal duties not listed, to be determined and assigned as needed. III. MINIMUM QUALIFICATIONS A. Education, Experience, and Training 1. Graduation from a law school accredited by an organization recognized by the Council for Higher Education Accreditation (CHEA) or by the United States Department of Education (USDE) with a Bachelor of Laws (LL.B.) or Juris Doctor (J.D.) degree. 2. Seven years full-time, wage-earning experience as a licensed attorney or in a legal clerkship with one year as legal counsel for a governmental agency. 3. Three years full-time, wage-earning experience in the supervision of employees. 4. Experience as a legal counsel in a governmental agency preferred. 5. Experience as a legal counsel in a criminal justice or law enforcement agency preferred. 6. Current license to practice law in the State of Texas. 7. Must maintain a current active license to practice law in the State of Texas during employment with the Texas Department of Criminal Justice (TDCJ) through the State Bar of Texas or other appropriate Texas licensing authority. * Applicants must meet the Texas Law Enforcement Telecommunications System (TLETS) access eligibility criteria as contained in the FBI Criminal Justice Information Systems Security Policy. Knowledge of local, state, and federal laws and regulations affecting Office of the Inspector General, Texas Board of Criminal Justice, and Texas Department of Criminal Justice agency operations. 2. Knowledge of legal principles and practices of public administration and management. 3. Knowledge of state government operations and the functions of criminal justice systems. 4. Knowledge of Texas Public Information Act. 5. Knowledge of agency and departmental organizational structure, policies, procedures, rules, and regulations preferred. 6. Skill to analyze and solve legal problems and interpret laws and regulations affecting the agency. 7. Skill to review and evaluate the impact of procedures, statutes, rules, regulations, policies, judgments, and litigation on the agency. 8. Skill to direct and organize a legal services program. 9. Skill to prepare legal documents. 10. Skill to review technical data and prepare technical reports. 11. Skill in public address. 12. Skill to coordinate with other staff, departments, officials, agencies, organizations, and the public. 13. Skill to communicate ideas and instructions clearly and concisely. 14. Skill in administrative problem-solving techniques. 15. Skill in teaching relevant materials. 16. Skill in scheduling of OIG investigators and staff for deposition or trial. 17. Skill to develop and present training materials relevant to OIG operations. 18. Skill to supervise the work of others. IV. ADDITIONAL REQUIREMENTS WITH OR WITHOUT REASONABLE ACCOMMODATION A. Ability to walk, stand, sit, kneel, push, stoop, reach above the shoulder, grasp, pull, bend repeatedly, climb stairs, identify colors, hear with aid, see, write, count, read, speak, analyze, alphabetize, lift and carry under 15 lbs., perceive depth, operate a motor vehicle, and operate motor equipment. B. Conditions include working inside, working around machines with moving parts and moving objects, radiant and electrical energy, working closely with others, working alone, working protracted or irregular hours, and traveling by car, van, bus, and airplane. C. Equipment (machines, tools, devices) used in performing only the essential functions include computer and related equipment, calculator, copier, fax machine, telephone, dolly, and automobile.
