Description

*This is a part-time position averaging 20 hours per week* GENERAL PURPOSE The Code Enforcement Officer performs a variety of working level duties as needed to ensure compliance with City codes, ordinances, regulations, and other compliance issues, such as zoning, planning, signage, business licensing, weeds, snow, parkstrips, street trees, rights-of-way, telecommunications, nuisances, drainage, etc. SUPERVISION RECEIVED Works under the general supervision of the Community Development Director. SUPERVISION EXERCISED None. ESSENTIAL FUNCTIONS Receives and responds to various problems and complaints regarding alleged violations of City ordinances, codes, and regulations; evaluates the nature of the allegations; investigates and gathers evidence regarding violations; and prepares detailed reports and conclusions of investigations. Provides updates to complainant of investigative progress, final conclusions, and corrective actions. Monitors business and property owner compliance with City ordinances, codes and regulations; monitors community compliance with various ordinances, such as nuisances, noise, snow removal, weeds, etc.; evaluates the nature of the allegations, investigates and gathers evidence regarding violations, and prepares detailed reports of violations and conclusions of investigations. Communicates with responsible persons or entities of complaints and alleged violations; advises property owners, builders, and contractors of potential violations; issues courtesy notices, notices of violations, citations, and corrective action notices for established violations in accordance with City ordinances and applicable State law provisions. Works with various department heads regarding enforcement of City ordinances and issuance of code violations within their jurisdiction, such as noise, snow removal, weeds, street trees, nuisances, zoning violations, public utility violations, encroachment into public rights-of-way, etc. Investigates complaints and alleged violations; searches tax records for ownership information; obtains facts necessary to determine property course of action; coordinates and monitors solutions and compliance. Conducts field investigations and property inspections to determine extent of violations; checks for "clear view" on corner lots, verifies business licenses, monitors sign compliance, monitors compliance with animal ordinances and contacts animal control as needed; cooperates with board of health in monitoring health and safety practices of business operations; prepares various investigative reports; initiates enforcement proceedings where appropriate and coordinates the same with City legal staff; may administer preliminary sanctions as allowed by City ordinance or code. Issues courtesy notices, notices of violation, citations, and corrective action notices in accordance with City ordinances; prepares documentation for issuance of civil or criminal citations; provides testimony in court as necessary on behalf of the City. Conducts follow-up investigations to ensure compliance with applicable City ordinances and codes; monitors progress on corrective action notices; issues follow-up notices for continued or repeat violations. Assists with appeals; prepares documentation and responds to arguments on appeal; testifies at appeal hearing as necessary on behalf of the City. Coordinates code enforcement activities with other City departments as necessary; works closely with members of the Community Development Department regarding interpretations and enforcement of codes. Provides information to the public, residents, businesses, and government agencies regarding codes, laws, and ordinances; respond to questions, complaints, and inquiries regarding code enforcement and violations; provides education and public outreach on various code enforcement issues. Collaborates with City departments and the community at large to address complex issues that require a coordinated response. Conducts regular review of City codes, ordinances, and regulations; receives legal interpretations as needed to direct enforcement of compliance; makes recommendations related to practical application of codes and ordinances; assists in adapting, modifying or rewriting codes as needed. Prepares and provides written and oral reports to City Council, City Manager, City Attorney, and Community Development Director, as required, to explain code enforcement activities and program needs. Maintain files and records related to code enforcement investigation, citations, and violations. Performs related duties as required. MINIMUM QUALIFICATIONS Education and Experience: Graduation from high school, plus two (2) years of specialized training provided through in-service, professional workshops, technical college or university studies AND Two (2) years of responsible experience performing above or related duties; preference for experience related to local government ordinance enforcement and investigation; law enforcement civil and/or criminal investigation, or some other related field; OR An equivalent combination of education and experience. Knowledge, Skills and Abilities: Working knowledge of liability issues which arise out of investigative procedures; effective interpersonal communications; City and state codes and ordinances related to multiple aspects of public works, property rights, boundaries, subdividing and zoning, signing etc.; legal system and securing sanctions for violations; various investigative techniques; report writing, public relations; municipal government operations, practices and procedures.         Skill in the art of diplomacy and cooperative problem solving, negotiating and public relations. Ability to enforce regulations with firmness, tact, and impartiality; keep operating records and maintain various written reports; read maps and locate property; establish and maintain effective working relationships with employees, other agencies and the public; comprehend and interpret complex regulations related to zoning and other city ordinances. Special Qualifications: Must possess a valid Utah Driver’s License. Must pass a pre-employment background check and drug screen. WORK ENVIRONMENT Tasks require a variety of physical activities not generally involving muscular strain. Physical demands may occur in activities related to walking, standing, stooping, sitting, reaching, etc. Talking, hearing and seeing required in the daily performance of job duties. Mental application utilizes memory for details, emotional stability and discriminating thinking and creative problem solving. Frequent local travel required in course of performing portions of job functions. This position has exposure to stressful situations associated with dealing with the public in sensitive and potentially volatile situations. Work is often performed under deadlines and time constraints. FLSA AND AT-WILL STATUS The Code Enforcement Officer is a non-exempt position under the Fair Labor Standards Act eligible for minimum wage and overtime pay under applicable provisions of the Fair Labor Standards Act. The Code Enforcement Officer is considered an at-will position and is not eligible for the protections of Utah Code § 10-3-1105.
