Comment vous créerez un impact Expert en sinistres, pertes majeures est responsable du traitement de divers types de réclamations complexes en assurance responsabilité civile commerciale, notamment les recours collectifs, les réclamations pour dommages matériels importants, les réclamations liées aux rappels de produits et autres réclamations en responsabilité civile générale. Il doit exercer ses fonctions conformément à toutes les directives opérationnelles aux meilleures pratiques en matière de gestion des sinistres. Ses responsabilités incluent notamment l’analyse et la détermination de la couverture applicable, la rédaction des lettres de réserve de droits et de négation, la participation aux médiations et aux conférences de règlement, ainsi que la coordination des experts indépendants et avocats externe dans le cadre de la négociation et du règlement des réclamations. Les réclamations concernent principalement le Canada, avec certains sinistres aux États-Unis et à l'international. Vos Responsabilités : Analyser les termes et condition des polices d'assurance afin de déterminer la couverture. Rédiger des lettres négation et/ou de réserve de droits et les communiquer aux assurés, courtiers et autres parties concernées. Donner des instructions claires aux avocats externes afin de d’assurer un règlement approprié des dossiers. S'assurer que les avocats externes respectent les lignes directrices en matière de litiges. Participer aux processus de médiation/conférence de règlement afin de parvenir à un règlement du sinistre. Procéder à des négociations de règlement direct lorsque les circonstances le permettent. Effectuer les paiements dans les délais prescrits. Appliquer les meilleures pratiques, notamment en matière de révision des réserves, de tenue de notes, de demandes de paiement, et de gestion de l’agenda. Informer la direction de toutes les plaintes, des sinistres importants, des problèmes de couverture, etc. Ce dont vous aurez besoin pour réussir : Détient une licence commerciale AMF valide La maîtrise de l'anglais et du français (verbal et écrit) est essentielle, car une partie des dossiers traités auront lieu à l'extérieur du Québec ou avec une clientèle anglophone. How you will create an impact The Major Loss Adjuster for Casualty is responsible for handling various types of complex commercial casualty claims including class actions, large property damage claims, product liability recall claims and other general liability claims and must operate in accordance within all operational/Best Practices guidelines. This would include determining coverage, drafting reservation of rights and denial letters, attendance at mediation / settlement conference and instructing independent adjusters and attorneys in the negotiation and settlement of claims. Claims are primarily in Canadian venues, with a small portion of US and worldwide exposures. What you need to know: Review casualty claims in conjunction with policy wordings to determine coverage  Prepare disclaimer and/or reservation of rights letters and communication same to underwriters, brokers and insureds when applicable Provide instruction to legal counsel to bring about appropriate resolution of claim Ensure compliance by legal counsel of our litigation guidelines Participate in mediation/ADR process to bring about resolution of claim Negotiate settlements directly where possible Issue payments within appropriate time frame Operate within our best practices guidelines, including timely reserve review, notes, payment requests, electronic diary Inform management of all complaints, large losses, coverage issues, etc. What we're looking for : Holds current AMF Commercial License Fluency in both English and French (verbal and written) is essential, as a significant portion of underwriting handled by the employee will occur outside of Quebec Minimum 10 years handling commercial casualty claims College/University or equivalent industry experience Ability to make decisions and give directions to adjusters and/or counsel Must be a quick learner with strong communication and negotiating skills Excellent interpersonal skills Proficient computer skills to navigate paperless claim file system Travel: Approximately 10% to attend mediations/ADR.
