GENERAL DESCRIPTION Our mission at the Texas Department of Motor Vehicles (TxDMV) is to serve, protect and advance the citizens and industries in the state with quality motor vehicle related services. We are a dynamic state agency dedicated to customer service, consumer protection and the success of motor vehicle-related industries. Performs advanced professional legal work concerning the compliance with and the interpretation of federal and state laws, rules, and regulations in support of the Texas Department of Motor Vehicles, Motor Vehicle Division (MVD). Coordinates MVD’s mediation program and serves at the Department’s primary mediator in negotiating the settlement of contested case matters. Represents MVD in hearings related to licensing cases to pursue denial or revocation of a license. Assists in preparing documents for the TxDMV Board’s consideration and may provide executive briefings. May prepare documents for appeals coordination. Works under minimal supervision with considerable latitude for the use of initiative and independent judgment. ESSENTIAL DUTIES Advises Department on broad range of legal issues related to the Motor Vehicle Division (MVD). Interprets laws, rules, regulations, case law, opinions, decisions, and court orders. Oversees and coordinates research to provide responses, analysis, and informal opinions to the public, including to licensees and industry representatives. Leads MVD’s mediation program and serves as the Department’s primary in-house mediator in contested cases related to protests between licensees. Works with the Division Director to formulate and establish policies and procedures for MVD’s mediation program. Works with the Office of General Counsel support staff to coordinate all mediation-related communications and support. Works with the Office of General Counsel to coordinate referrals of licensing contested cases to the State Office of Administrative Hearings. Serves as legal counsel on MVD’s Licensing Committee, reviewing and providing legal research and guidance for determinations related to licensing applications. Represents MVD in hearings for certain licensing cases referred for denial or revocation of the license by the Licensing Committee. Prepares MVD and other Department staff for hearings and trials related to licensing cases. Presents arguments related to certain MVD Licensing Committee cases referred for denial or revocation of a license. Formulates and recommends rules and policies. Assists with drafting administrative rules and assists the Office of General Counsel in preparing documents for filing with the Secretary of State. Advises and collaborates with state agency staff outside of the Motor Vehicle Division. Communicates regularly with governmental agencies and private entities. Works with MVD’s Management Analyst to analyze proposed legislation, draft bill analyses, and assist with drafting amendments to or substitutes for pending legislation. Assists with drafting agenda items for board meetings. May travel up to 10% of the time. Travels by car (may include flying). May include overnight travel. May require working extended hours and some evenings and weekends, as needed. Required to attend work regularly and adhere to approved work hours in accordance with department policies and procedures. Performs other job-related duties as assigned. KNOWLEDGE, SKILLS, ABILITIES Extensive knowledge of applicable laws, rules, and regulations. Knowledge of mediation, facilitation, and negotiation practices and methods. Developing, interpreting, and implementing policies, procedures, and technical information. Researching, analyzing, and interpreting policies and state and federal laws and regulations. Analyzing, organizing, and communicating complex ideas and information clearly, concisely, and effectively. Interpreting and applying laws, rules, and regulations. Preparing legal documents including opinions, case law summaries, and legislative impact statements. Assigning, reviewing, and monitoring the work of others. Prioritizing and organizing work assignments. Knowledge of the legislative process, to include writing operational and fiscal impact statements. Interpreting and analyzing legislation, rules, and regulations. Analyzing and organizing legal data.
